LIABILITY WAIVER FORM

Firearms, Self-Defense and Tactical Training

Handling firearms and engaging in strenuous defensive training, no matter how carefully, is an inherently dangerous activity. All training programs are planned and supervised with reasonable care taken to prevent any injury and to minimize the possibility of accidents. However, because of the hazardous nature of shooting and defensive tactical training, no one can assure the students or instructor that injury will not result even during the properly supervised sessions. Neither Spartan Defense Armory & Training, nor any of its affiliates, instructors or representatives assumes any responsibility for any injury to any individual.

Spartan Defense Armory & Training provides specialized training programs in a variety of indoor and outdoor facilities and with a variety of equipment. All training is planned with reasonable care taken to prevent any injury and to minimize accidents. The techniques and tactics taught in this program can be extremely dangerous. Neither Spartan Defense Armory & Training nor its agents assumes any responsibility for the use and misuse of the information taught in these programs. MANY OF THE TECHNIQUES AND PROCEDURES USED DURING THE TRAINING ARE NOT INTENDED TO BE ATTEMPTED WITHOUT THE SUPERVISION OF AN INSTRUCTOR.

1. Voluntary Participation: I __________ acknowledge that I have voluntarily applied to engage in training and/or shooting activities under the supervision of Spartan Defense Armory & Training.
2. Assumption of Risk: 1) AM AWARE THAT SHOOTING, WEAPONS AND DEFENSIVE/TACTICAL TRAINING IS A HAZARDOUS ACTIVITY. 2) AM VOLUNTARILY ENGAGING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED, HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH AND VERIFY THIS STATEMENT BY PLACING MY INITIALS HERE: __________
3. Release: As consideration for being permitted by Spartan Defense Armory & Training to participate in these activities and use related facilities, I hereby agree that I, my heirs, distributes, guardians and legal representatives will not make a claim against, sue, or attach the property of the Spartan Defense Armory & Training or any of their affiliates, on account of injury or damage resulting from the negligence or other acts, howsoever caused, by any principal, employee, agent, or contractor of Spartan Defense Armory & Training as a result of my participation in shooting, weapons, and defensive/tactical training activities. I hereby release Spartan Defense Armory & Training and all their affiliates, from all actions, claims or demands that I, my assignees, heirs, distributes, guardians and legal representatives now have or may have in the future for injury or damage resulting from my participating in shooting, weapons and defensive/tactical training.
4. Rules and Regulations: I agree that I will at all times comply with all rules, procedures and regulations which may be promulgated by Spartan Defense Armory & Training, and will conform to and obey all instructions provided by instructors.
5. Physical Conditions: I hereby declare that I am in good health and fully aware of my personal medical condition and hereby certify that I have medical approval to engage in strenuous activity.
6. Confidentiality, Legal Status, Intentions and Responsibility: I acknowledge that I am not a representative of Spartan Defense Armory & Training or any of their affiliates unless through a separate written agreement. I agree to use all of the techniques, tactics and training learned while participating in activities with Spartan Defense Armory & Training in a responsible and appropriate manner and that I am not restricted from access to firearms or any other required equipment by any legal entity, nor have I been adjudicated mentally unstable or a danger to myself or others in any jurisdiction, nor do have any intention of using the skills or techniques learned under Spartan Defense Armory & Training to harm any person or government except in defense of my own life or the lives of others.
7. I understand and acknowledge the following items:
   1. During live fire and explosives training sessions, the use of eye and ear protection is required at all times on the range. Anyone found removing safety equipment without specific instruction from an employee of Spartan Defense Armory & Training may be removed from the facilities.
   2. Firing a firearm at other than approved targets will result in removal from the range and liability for the damages.
   3. Anyone consuming alcoholic beverages or suspected by Spartan Defense Armory & Training staff to have been consuming alcoholic beverages during a training session or suspected of being under the influence of alcohol or any substance that can cause any kind of impairment, be it physical or psychological, will be removed from training activities.
   4. Anyone acting in an unsafe manner, against instructions of Spartan Defense Armory & Training or agents will be removed from training activities.
   5. No part of Spartan Defense Armory & Training activities are meant to be legal advice. You are ultimately responsible for your own actions. Be sure to have knowledge of the laws governing the carrying and use of firearms, other items and the use and practice of various techniques in your areas of operation.
   6. Appropriate protective gear and procedures must be used at all times as recommended by Spartan Defense Armory & Training and its agents during training activities.
   7. Spartan Defense Armory & Training HAS THE FINAL SAY. THERE ARE NO ARGUMENTS OR REFUNDS WHEN A STAFF MEMBER REMOVES A STUDENT FROM THE TRAINING ACTIVITIES.
   8. THE STRICTEST DISPLINE MUST BE MAINTAINED AT ALL TIME ON FIRING RANGES IN ORDER TO PREVENT ACCIDENTS AND INJURIES. BY SIGNING BELOW YOU AFFIRM THAT YOU HAVE BEEN GIVEN A COPY OF THE RANGE RULES, HAVE READ THE RULES, UNDERSTAND AND WILL OBEY ALL OF THE RULES.
8. Model Release: By my participation in these activities, I grant permission to Spartan Defense Armory & Training, or its designees, to use recording of my voice, actions and image in promotional and educational endeavors without expectation of compensation or notification.
9. IF YOU ARE PREGNANT YOU ARE NOT PERMITTED TO TAKE ANY FIREARMS COURSE.
10. Knowing and Voluntary Execution: 1) HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS CONTENTS. 2) AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN ME AND Spartan Defense Armory & Training AND 3) SIGN IT OF MY OWN FREE WILL.
